Please read these Terms of Services ("Agreement") carefully before using http://pvco.co ("the Site") operated by POVU Collective, Limited (“POVU”, ”us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://pvco.co.
By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Services. Capitalized terms are defined in this Agreement.
1. Intellectual Property
The Site and its original content, features and functionality are owned by POVU and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
2. Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
3. Links To Other Sites
Our Site may contain links to third-party sites that are not owned or controlled by POVU.
POVU has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.
4. Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the Republic of Korea, without giving effect to any principles of conflicts of law.
5. Submissions.
When you submit questions, comments, suggestions, ideas, message board postings, material submitted via web forms, external links, communications or any other information ("Submissions"), you grant POVU permission to use such submissions for marketing and other promotional purposes. You agree that POVU will have no obligation to keep any Submissions confidential.
6. Representations and Warranties.
(a) Mutual Representations and Warranties. You represent and warrant to POVU and POVU represents and warrants to you: (i) that you or it has the full power and authority to enter into and perform under this Agreement, (ii) the execution and performance of your or its obligations under this Agreement do not constitute a breach of or conflict with any other agreement or arrangement by which you or it is bound, and (iii) the Agreement is a legal, valid and binding obligation of the party entering into this Agreement, enforceable in accordance with their terms and conditions.
(b) By You. You represent and warrant to POVU that, in your use of the POVU Service, you: (i) will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other legal right of any third party and (ii) will comply with all applicable laws, rules, and regulations. You further represent and warrant to POVU that: (i) there are no claims, demands or any form of litigation pending or, to the best of your knowledge, threatened with respect to any of your Submissions; (ii) POVU will not be required to make any payments to any third party in connection with its use of your Submissions; (iii) the use of any instructions, formulae, recommendations, or the like contained in your Submissions will not cause injury to any third party; and (iv) your Submissions does not contain viruses or any other programs or technology designed to disrupt or damage any software or hardware.
7. Changes To This Agreement
We reserve the right, at our discretion, to modify or replace the Agreement posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new terms of services.
Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
